Terms of Service

By using CharityGrantWriter, you agree to these terms. We've written them plainly. Please read them, and if you have questions, email hello@charitygrantwriter.com.

1. Accepting These Terms

These Terms of Service ("Terms") govern your use of CharityGrantWriter ("the Service"). By using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm that you have authority to agree to them for that organization.

2. What the Service Does

CharityGrantWriter helps nonprofits find foundations that have funded work like theirs, and helps them write to those funders. It provides:

• Foundation matches for each program you tell Sam about, drawn from the grants US private foundations report to the IRS on Form 990-PF, with the past grants behind each match.
• First drafts of concept notes and introduction emails, written by Sam, our writing assistant, from the facts you provide and in your organization's writing style.
• A workspace with your programs, a document library, your organization details and a grant tracker.

Today the Service is available to US nonprofits through the US Beta. We're building it for Canada and the UK.

3. Eligibility

You must be at least 18 years old and have authority to use the Service for your organization. The Service is intended for nonprofit and charitable organizations. Use by for-profit businesses for their own grant applications needs our written permission first.

4. Your Account

• Keep your login details secure.
• Give accurate information about yourself and your organization.
• You're responsible for activity under your account.
• Tell us straight away at hello@charitygrantwriter.com if you think someone else has accessed your account.

5. Acceptable Use

You agree not to:

• Use the Service to create fraudulent or misleading grant applications.
• Give false information about your organization, budget or programs.
• Scrape, copy or resell our matches, funder information or the Service itself.
• Use automated tools to create accounts or run searches at scale.
• Break any law, including laws against grant fraud.
• Try to get around our security or limits, or access other people's data.

6. Drafts Written by Sam

Sam uses artificial intelligence to write drafts. You acknowledge that:

• Drafts may contain mistakes or leave things out. Sam marks information it doesn't have for you to fill in.
• You must review and edit every draft before you send it.
• Sending an application or email to a funder is your decision and your responsibility.
• We don't guarantee that any draft will lead to funding.

You own the drafts written for your organization and can use them however you like.

7. Funder Information

Matches and funder details come from the public filings foundations make to the IRS, which can be a year or more out of date. A foundation's priorities, deadlines, eligibility and grant sizes may have changed since it filed. We don't guarantee that funder information is complete or current, so always check with the funder before you apply.

8. Intellectual Property

Your content: you keep all rights to the information and documents you give us about your organization. You give us a limited license to use them to provide the Service to you.

Our content: CharityGrantWriter's software, design, matching methods and compiled funder data belong to us. You may not copy, distribute or create derivative works from them without our written permission.

9. Pricing and Payments

The US Beta: 4 weeks of full access, free, with no card needed. Your 4 weeks start the day we approve your request (or the day you use a beta code we sent you).

Plans:

• Founding price: $75 a month or $750 a year, for US Beta members who subscribe and haven't previously cancelled a subscription. It stays at that price for as long as you stay continuously subscribed.
• Usual price: $149 a month or $1,490 a year.
• What a plan includes: 5 program searches and 15 new proposals a month, up to 5 redrafts of each, and 20 detailed funder profiles a month. Editing, copying and downloading are unlimited. Monthly limits reset on the same day each month. We may also apply fair-use limits to protect the Service.

Billing:

• Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method each month or each year, depending on your plan, until you cancel.
• If you choose a plan during your beta, your first payment is taken when your beta ends. Otherwise, you're charged when you subscribe. Your plan renews on the same date each month or year.
• Your invoices are available under Manage billing on your account page.

Cancelling:

• Cancel any time with Manage billing on your account page. Your plan stays active until the end of the period you've paid for.
• We don't give refunds for part of a billing period unless the law requires it.
• The founding price ends when your subscription ends, and isn't available again.
• Deleting your account cancels your subscription straight away.
• If you don't subscribe after your beta, or you cancel, you keep a free account with everything you've made.

Refunds:

• If you think a charge was made in error, email hello@charitygrantwriter.com within 14 days of the charge. We look at refund requests case by case and aim to be fair.
• In the EEA and UK, you have a 14-day right to withdraw from a digital service from the date you buy it, unless you've already used it. By using the Service straight after subscribing, you agree that this right doesn't apply to what you've already used.

Price changes: we'll tell you at least 30 days before a price change by email. If you keep your plan after the change takes effect, you accept the new price. The founding price is protected from general price rises for as long as you stay continuously subscribed.

10. Privacy

Our Privacy Policy explains how we collect, use and protect your data. Your account data is kept while your account is open and deleted within 30 days of closing it.

11. Disclaimers

The Service is provided "as is", without warranties of any kind, express or implied. We don't promise that:

• The Service will always be available or free of errors.
• Matches will include every suitable funder, or that every match will suit your organization.
• Drafts will meet any particular funder's standards.

12. Limitation of Liability

To the fullest extent the law allows, our liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months before the claim, or $50 if you haven't paid us. We aren't liable for indirect, incidental or consequential losses, including grants or funding you didn't receive.

13. Indemnification

You agree to indemnify CharityGrantWriter against claims, losses or damages arising from your use of the Service, your breach of these Terms, or false or fraudulent information you provided.

14. Ending Your Use of the Service

You can close your account at any time with Delete My Account on your account page, or by emailing us. We may suspend or close your account if you break these Terms, particularly the Acceptable Use rules. When an account is closed, your data is handled as our Privacy Policy describes.

15. Changes to These Terms

We may update these Terms as the Service changes. We'll tell account holders about material changes by email and update the date at the top of this page. If you keep using the Service after we've told you, you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved through binding arbitration under the American Arbitration Association rules, except that either party may seek injunctive relief in court for IP violations.
